Data Controller Application Form

1. General Explanations

Under Article 11 of the Law No. 6698 on the Protection of Personal Data (“GDPR”), personal data owners ("Applicant") defined as data subjects are granted the right to request certain actions regarding the processing of their personal data.

This application form has been prepared to identify your relationship with Sem Dayanıklı Tüketim Malları Pazarlama ve Dış Ticaret A.Ş. ("Sem Dayanıklı"), and to fully determine any personal data processed by Sem Dayanıklı, in order to provide a correct and legal response to your application within the legal timeframe. To ensure the security of your personal data and to prevent unlawful data transfers, Sem Dayanıklı may request additional information to verify identity and authority. If the information provided by the Applicant is incorrect and/or outdated, or if the requests are unauthorized, the responsibility for this lies with the Applicant.

In accordance with Article 7 of the Regulation on the Principles and Procedures of Application to the Data Controller, if a written response is given to the Applicant's request, no fee will be charged for up to ten pages. For each page beyond ten, a processing fee of 1 Turkish Lira may be charged. If the response to the request is provided in a recording medium such as CD or flash drive, a fee may be charged for the cost of the recording medium.

2. Scope of Application Rights Under Article 11 of the GDPR

The Applicant can apply to Sem Dayanıklı to make requests in the following areas:

1) To learn whether their personal data is being processed,
2) To request information about their processed personal data,
3) To learn the purpose of processing their personal data and whether it is being used in accordance with that purpose,
4) To learn the third parties to whom their personal data is transferred, whether in Turkey or abroad,
5) If their personal data is incorrect or incomplete, to request correction and for the correction to be communicated to the third parties to whom the data has been transferred,
6) Even if their personal data has been processed in accordance with the GDPR and other relevant laws, to request deletion, destruction, or anonymization of their personal data when the reasons for processing no longer exist, and to request that this action be communicated to the third parties to whom the personal data was transferred,
7) To object to the result that arises solely from the automated processing of their personal data,
8) To request compensation for damages in case of suffering any damage due to the unlawful processing of their personal data.

3. Application Method

According to the first paragraph of Article 13 of the GDPR, applications regarding these rights must be submitted in writing and signed or by other methods determined by the Personal Data Protection Board ("Board").

In this context, written applications can be submitted by printing this form and:

  • Submitting in person with an identity document,
  • Via notary public,
  • Through Registered Electronic Mail (KEP) with a secure electronic signature, mobile signature, or
  • By email from the electronic mail address previously provided and registered in our system.

Sem Dayanıklı may request additional information to verify the identity of the Applicant in cases where applications are made by email, and will take necessary precautions.

Applications sent to us will be responded to in writing or electronically within thirty days from the date of receipt of the request, in accordance with the second paragraph of Article 13 of the GDPR.
